Court documents confirmed that both were aware that the jobs listed in the petitions did not exist and supplied other customers with H-1B aircraft.
One US policy professional has expressed shock and surprise at how little talk there is about the H-1B visa situation in India – and how difficult it is to return to the US once you exit it and the visa stamp expires.
Sam Beck, policy director at the Economic Innovation Group, said he received a text from someone with H-1B status who had to get up at 3:30 a.m. to make a consular appointment for August 2027.
Beck said the issue is still under discussion while there are a lot of talks about the likely H-1B lottery, pay levels, a firewall project to stop H-1B scams, etc.Peck noted that on a very basic level, the White House has made returning to the United States very difficult.“Wait times at Indian consular offices are usually ridiculous, but visa holders can circumvent these backlogs by going to US embassies with less bureaucratic pressure (like Canada) to renew their visas. The White House ended this practice last year. Now, if an H-1B Indian needs to travel for work or has a family emergency back home, he will not be able to leave and return smoothly,” Peck added.
A major stalemate arose in December 2025 when consular offices in India rescheduled and postponed all H-1B and H-4 visa appointments until mid-2026. All dates were postponed and no new appointments have been opened in India in the past six months. Reports are now emerging that some dates are opening up randomly in June and July this year, whereas until a few months ago, the situation was such that no slot was available in India until 2027.Appointments have been rescheduled en masse due to the new policy of social media screening of visa holders for which the consular offices have reduced the number of appointments per day. With hundreds of H-1B visa holders stuck in India for an indefinite period, their employers were in a dilemma with only a few allowing them to work from India.
