A bench comprising Chief Justice Surya Kant and Justice Jayamalya Bagchi pulled up the party for trying to use the court to garner attention after losing the election. It asked the petitioner to approach the Patna High Court as the issue pertains to only one state.

“How many votes have you got? When the people reject you, you use the judicial forum to get relief! Then one should have challenged the scheme itself. This is not a prayer before us. You only seek a universal direction to declare the election of the entire state null and void,” the chief justice was quoted as saying by news agency PTI.

The bench observed that the petition was effectively a collective election petition covering the entire state.

“As it relates to only one state, please go to that high court. In some cases, there is a serious issue of free will which we will examine seriously,” the bench said.

What is said in the application of the party?Senior advocate CU Singh, appearing for Jan Suraj, said the scheme under which money was paid to voters was announced shortly before the elections. He also said that the money was distributed while following the code of conduct.

“But when a state has a severe revenue deficit and it is a detriment in the sense that 10,000 will be paid immediately and more than 35 lakh people are enrolled in the scheme soon after the MCC is announced,” the senior lawyer said.

“Direct transfer schemes are different. It is about women’s self-help groups,” the bench said

The Jan Suraj Party (JSP) approached the Supreme Court seeking fresh elections in Bihar after the BJP-led National Democratic Alliance retained power by winning 202 seats in the 243-member assembly. India Bloc won 35 seats. The JSP did not win any seats, and most of its candidates lost their securities.

The petition alleged that the state government had violated the Code of Conduct by making the transfer ₹10,000 to women beneficiaries under the Chief Minister Mahila Rozgar Yojana after announcing the election schedule.
