NEW DELHI: A Delhi court has convicted three men for the 2019 murder of a man in Badarpur district, saying the prosecution had proven beyond reasonable doubt that they acted with a common intention to stab him to death over a previous rivalry.
Additional Sessions Judge Anuj Agrawal was hearing a case against Manish alias Shivam, Nishu Jha and Diwakar alias Munu, who were accused of stabbing and killing Ram Prakash on September 4, 2019.
In an order dated July 10, the court said: “The accused persons are liable for the offense punishable under Section 324 read with Section 34 IPC in this regard and also for the offense punishable under Section 302 read with Section 34 IPC in relation to causing death of Ram Prakash.”
An FIR has been registered at Badarpur police station against the accused under Sections 302/34 and 324/34 of the IPC.
However, the court acquitted Nishu Jha of the charge under Section 25 of the Arms Act, saying that the prosecution had failed to prove that the knife recovered fell within the prohibited category or that it was owned for any purpose covered by the law.
According to the prosecution, Ram Prakash and his two sons Sourav and Ravi were returning home after attending a birthday party on September 4, 2019, when the three accused intercepted them at Mullarband annex.
The court relied heavily on the testimony of Sourav, the deceased’s son and the only eyewitness, saying his story remained consistent despite lengthy interrogation and was supported by medical and forensic evidence.
“The testimony of PW-4, who is also injured, stands on a high foundation of credibility and deserves full acceptance,” the judge said.
While the court convicted the defendants of murder, it convicted the three of voluntarily causing harm using dangerous weapons.
The court set a session for July 23 to hear the punishment for the convicts.
