The move came after former AAP deputy leader in the Senate Raghav Chadha announced that a majority of the party’s MPs in the Rajya Sabha have decided to merge with the BJP.

“We have decided that we, two-thirds of the members belonging to AAP in the Rajya Sabha, will exercise the provisions of the Constitution of India and merge with the BJP,” Chadha told the media on Friday.

He added that seven MPs signed the letter formalizing the decision, which was submitted to the Rajya Sabha Speaker. Following the announcement, the lawmakers also met BJP president Nitin Nabin.

AAP is considering anti-defection provisions

Earlier on Friday, AAP leader Sanjay Singh said the move would be challenged under the Constitution’s anti-defection provisions.

Raghav Chadha News Live Updates: Swati Maliwal claims Kejriwal is ‘anti-women’ after joining BJP

Raghav Chadha News Live Updates: Rajya Sabha MP Swati Maliwal on Saturday leveled serious allegations against Aam Aadmi Party (AAP) chief Arvind Kejriwal, calling him “anti-women” and accusing him of being involved in “corruption and goondagaardi”.

Maliwal made the remarks a day after he officially joined the BJP.

Speaking to news agency ANI after joining the party, she said: “I joined the BJP not under any compulsion, but because I believe in Prime Minister Modi’s leadership. I urge all those who want to do constructive politics to join the BJP.”

Announcing her exit from the Aam Aadmi Party, Maliwal said that she has been associated with Kejriwal since 2006 and supported him through various movements. But she claimed that she was later subjected to “harassment and pressure” within the party.

“Arvind Kejriwal beat me up by a criminal at my home. I was threatened when I raised my voice against it and he put immense pressure on me to withdraw the FIR I had lodged over this incident. The party has deprived me of any opportunity to speak in Parliament for two years, which is very shameful. Arvind Kejriwal is anti-women,” she told the news agency.

“Now, they have entered Punjab, and the state government is being controlled remotely, turning Punjab into their personal ATM,” she added.

Raghav Chadha News Live Updates: Sanjay Singh says defections ‘not allowed’ even in ‘two-thirds majority’

Raghav Chadha News Live Updates: AAP leader Sanjay Singh on Saturday said the party will write to Rajya Sabha Speaker CP Radhakrishnan seeking the disqualification of seven MPs who left the party the previous day.

Singh claimed that the step taken by the MPs had no constitutional legitimacy under the anti-defection framework.

“The anti-defection law clearly states that any kind of division or faction cannot take place in the Rajya Sabha and Lok Sabha. It does not carry any legal recognition, even if it gets a two-thirds majority,” the agency quoted him as saying.

He further said that neither the anti-defection law nor the Tenth Schedule of the Constitution recognizes any faction, splinter group or faction in either House of Parliament, irrespective of numerical strength.

Terming the move “unconstitutional” and “illegal”, Singh said the MPs’ decision to ally with the BJP could not be treated as a valid political merger.

He added: “I am writing to the Vice President of India and the Chairman of the Rajya Sabha, to exclude the seven MPs.”

Raghav Chadha News Live Updates: What comes under anti-defection law

Under the anti-defection law, the final decision now rests with Rajya Sabha Speaker C P Radhakrishnan, who will examine whether the alleged merger meets the conditions stipulated in the Tenth Schedule of the Constitution.

The provisions require the chairman to evaluate whether the move qualifies as a valid merger – including whether the required two-thirds of members supported it.

The outcome of this investigation will be crucial, because it will determine whether the representatives will retain their seats or face exclusion from the House of Representatives.
