Hyderabad: In a huge relief to BRS chief K Chandrasekhar Rao and three others, the Telangana High Court on Wednesday ordered that no action can be taken against them on the basis of the findings of the PC Ghose committee, which investigated alleged irregularities in the implementation of the Kaleshwaram irrigation project.

However, while delivering its order on a batch of petitions filed by KCR, former minister T Harish Rao and others, a division bench of Chief Justice Aparesh Kumar Singh and Justice JM Mohiuddin said the constitution of the commission is not arbitrary, illegal or unconstitutional.
“…the findings of the Commission which are prejudicial to the conduct and reputation of the petitioners and which have been made in violation of the principles of natural justice and statutory safeguards provided under Section 8B of the Commissions of Inquiry Act, 1952, will be invalid and no action can be taken on the basis thereof,” the court said.
Last month, the court postponed the hearing on the petitions to April 22.
The committee, headed by retired Supreme Court judge Justice BC Ghose, which investigated alleged irregularities in the construction of the Kaleshwaram Lift Irrigation Project during the BRS ruling, had earlier submitted its report to the government.
The report was submitted to the state assembly in August last year and after discussion, Chief Minister A Revanth Reddy announced the government’s decision to hand over the investigation to the CBI.
In its report, the committee held Chandrasekhar Rao responsible for alleged irregularities in the construction of the project and other aspects. The report also found fault with Harish Rao, KCR’s nephew and irrigation minister during the BRS regime besides the role of some officials among others in constructing the barrages and other components of the project.
Challenging the report, KCR, Harish Rao and others approached the Supreme Court seeking its quashing.
