No one seems to be concerned: Immigration attorney asks companies to reach out to Congressmen on H-1B visa stamping delay in India

Immigration lawyer Emily Newman said businesses should reach out to their congressmen and senators and inform them of the H-1B visa stamping delay in India affecting their business.

Immigration lawyer Emily Newman said that the current situation of visa stamping delay in India has no possible solution, as no one seems to be bothered, as thousands of H-1B visa holders are stranded in India.

Newman said companies should reach out to members of Congress and urge them to find a solution to the situation as companies in America are affected“I don’t see anyone urging the State Department to improve the situation. Normally, we would hear from members of Congress urging the State Department, ‘Hey, we need to open up more visa appointments because this is hurting business, this is hurting people’s ability to travel,’ and I’m not hearing anything about that right now.”

There doesn’t seem to be any kind of concern, which tells me they’re not planning to improve anything.

“Because no one seems to be overly concerned about it,” Newman said. The lawyer said companies should contact their members of Congress and senators to inform them of the situation, which affects their businesses and employees. “Until someone complains about it, there doesn’t seem to be any incentive for the department to do anything,” Newman said, adding that the State Department and Secretary of State Marco Rubio are the only ones who can do anything about it.

Immigration lawyer Rahul Reddy said that the Donald Trump administration cannot place legal restrictions on H-1B, and this is Donald Trump’s way of obstructing H-1B visa holders. He said that the Trump administration has learned from its past mistakes, and now they know that they can do a lot when visa holders are outside the United States and not inside the United States, and hence they advise visa holders not to travel outside the United States. Currently, there are no interview appointments available at four consulates within India, and the earliest appointment date is around March 2027. This situation has arisen from the rescheduling of group interview dates undertaken by the Department in December 2025 due to social media screening of H-1B and H-4 visa holders. When hundreds of Indians traveled to India during the months of November and December, and also made their appointments at the embassy to get their new visa stamped during that period, they got stuck in India because they could not return to the US.

Some companies have allowed them to work from India, but the overall situation is in limbo.
