What started as a family outing at a Washington state park ended in tragedy when a 3-year-old boy crushed a large stone monument that fell within seconds, according to a lawsuit filed by his parents.Caleb Ortega died after a monument fell on him at Rocks Park in Walla Walla on April 1. The little boy was in the park with his father, Miguel Ortega, and his five-year-old sister when the accident happened.His parents, Miguel Ortega and Claudia García, have launched legal action against several companies involved in the design, construction and installation of the monument.According to the lawsuit, the monument commemorating U.S. Navy Captain Albert H.
Rooks and the USS Houston CA-30 were too heavy and inadequately supported.The suit alleges that the structure “fell within seconds, crushing Caleb.”Paramedics took the child to the hospital, but he later died of his wounds.The tragedy became even more devastating for the family because Caleb’s mother was working as a nurse at the same hospital when her son was taken by ambulance.Garcia witnessed emergency efforts to save her son’s life.
The experience caused severe emotional trauma, the suit says.The family is seeking damages for wrongful death, as well as the emotional distress suffered by Caleb’s parents and sister, who witnessed the incident firsthand.In the wake of the tragedy, a fundraising page has been launched to support the family.“In what started out as a normal, happy day filled with play, an unimaginable accident occurred and Caleb was taken from us far too soon,” the GoFundMe page says.“No one could have predicted the heartbreak that would follow.”“Caleb was a happy, busy little boy who filled every moment with life.”“He was always on the go, and was happiest when he was playing and exploring, especially when he was with his big sister, his best friend. The two spent hours together, laughing and playing, and making memories that their family will treasure forever.”The page also mentioned his love for huge trucks.“Caleb had a special love for monster trucks and took pride in his collection. Every night before bed, he would line them up carefully, showing off his sweet, thoughtful little personality.”“His smile and those beautiful, bright eyes could light up a room, and he was so loved by everyone who knew him. He brought so much joy to his family and friends, and being with him was truly special.”The lawsuit says park visitors should have been warned of the potential dangers posed by the monument and alleges negligence in its design, construction or maintenance.Defendants include Boulder Designs, Boulder Designs Franchising LLC, Border Magic, Builders FirstSource Inc., American Rock Products, Wenzel Nursery, Double T Construction Ltd., Neil Binder and the Binder matrimonial community.The US Army Corps of Engineers, which manages Rocks Park, temporarily closed the site for two weeks after the incident and fenced off the area. The memorial has since been removed.The defendants have been notified of the lawsuit but have not yet filed responses.
