The Delhi High Court on Tuesday allowed the transfer of activist Sonam Wangchuk from Safdarjung Hospital to Medanta Hospital in Gurugram, observing that such an order would fulfill the constitutional mandate of protecting Wangchuk’s fundamental rights enshrined not only under Article 19 but also Article 21 of the Constitution.
The bench of Chief Justice D K Upadhyaya and Justice Tejas Karia also directed Medanta director to form a committee of doctors to supervise the treatment of the activist.

“In view of the submission made by counsel for both parties, the views expressed by the doctors present and the concerns raised by them, we are of the view that the appellant’s husband should be transferred to a hospital of his choice. At the hearing of the matter before the court, the appellant stated that the appellant could be medically cared for at Medanta, Gurgaon which is the hospital of his choice. If the appellant’s husband is transferred to Medanta, it would be in fulfillment of the requirement to ensure his fundamental rights as provided not only in Article 19 but also in Article 21,” the court said in its order.
“In view of the above, we direct that the appellant’s husband be immediately transferred to Medanta Hospital Gurgaon. The Director of Medanta Hospital constitutes a team of requisite experienced doctors who are constantly monitoring the medical condition of the appellant’s husband and are also administering medication as may be required as per accepted medical standards and protocols,” it added. Wangchuk, who has been on an indefinite hunger strike at Jantar Mantar for over 20 days over NEET exam irregularities, was taken to Safdarjung Hospital by Delhi Police on Saturday morning.

Following the court order, the activist was transferred to Medanta Hospital amid tight security measures.
Adequate security arrangements have been made,” a senior Gurugram police officer told HT.
The officer added that security teams will be deployed at the hospital until further notice.
