The Meghalaya High Court on Monday rejected the state government’s petition to cancel the bail granted to Sonam by a trial court on April 27.

Speaking to PTI about the Supreme Court ruling, Raja’s elder brother Vipin Raghuvanshi in Indore said, “We will appeal to the Supreme Court to cancel Sonam’s bail and will soon start the petition process.”

He expressed his dissatisfaction with the prosecution’s handling of the case, and said that his family would fight the legal battle for justice on their own and would hire a private lawyer.

He said he still cannot understand how the Meghalaya Police committed a legal error in not informing Sonam of the reasons for the arrest when she was arrested.

In its order issued on Monday, the Meghalaya High Court cited serious errors committed by the police in informing Sonam of the reasons for her arrest.

The High Commissioner said: “If this is the way in which the grounds for arrest are announced, it reflects a complete lack of application of common sense on the part of the arresting agency, which strikes at the root of the process of arresting the accused person, leading this court to reach the conclusion that the detainee has a strong case to assert that these effective grounds were never intimated to her at the initial stage of her arrest.”

It said that the provisions of Section 22(1) read with Section 47(1) of the Bharatiya Nagrik Suraksha Sanhita (BNSS) Act had already been violated.

Article 22(1) of the Indian Constitution guarantees an arrested person the right to be informed of the reasons for his arrest and to consult a lawyer of his choice, while Article 47(1) of the Indian National Security System requires the police to inform the accused of the charges against him and the reasons for his arrest at the time of arrest.

Officials said Sonam was arrested on June 9, 2025, from Ghazipur, Uttar Pradesh, on charges of conspiring to kill her husband, Raja Raghuvanshi. She remained in judicial custody in Shillong district jail for more than 10 months before being released on bail.
