The Madhya Pradesh High Court had late on Wednesday canceled the anticipatory bail granted to Giribala in connection with the death case.

Toysha was found dead on May 12, and an FIR was lodged on May 15. On the same day, a Bhopal court granted interim bail to her mother-in-law while retired judge Samarth Singh’s son remains in CBI custody.

Hearing the matter, Justice Devanarayan Mishra of the Supreme Court pointed out the repeated allegations, non-cooperation in the investigation, serious nature of the crime, and failure of the trial court to properly examine the evidence while quashing the May 15 bail order.

“The anticipatory bail order passed by the 10th Additional Sessions Judge, Bhopal, for offenses punishable under Sections 80(2), 85, 3(5) of the BNS, 2023, and Sections 3 and 4 of the Dowry Prohibition Act, 1961, is set aside,” the court said.

Twisha’s father expresses gratitude to Supreme Court

Following the court’s decision to cancel the anticipatory bail granted to Giribala, the victim’s father Navnidhi Sharma expressed his gratitude to the judiciary and everyone who supported the family in their fight for justice.

Speaking to ANI, Navnidhi Sharma said, “I express my gratitude to everyone who has stood by us so far in this fight for justice. I pray that this is just the first step in this fight.”

He also thanked the Supreme Court and Chief Justice of India for their interest in the case.

Describing the Supreme Court order as an important message to the society, Sharma said he has confidence in the ongoing investigation being conducted by the Central Bureau of Investigation.

He added: “This has sent a very positive message throughout the community. I have confidence in the judicial process, especially in the CBI, that they will uncover the full truth and shed light on it.”
