The Supreme Court rejects a petition seeking restrictions on mosques bearing the name of Babur across India

New Delhi: The Supreme Court on Friday rejected a petition seeking to restrict the construction of any mosque dedicated to Mughal Emperor Babar.The petition said that any mosque in the name of Babur or Babri Masjid should not be built anywhere in India on the grounds that the Mughal ruler Babar was an anti-Hindu invader.A bench of Justices Vikram Nath and Sandeep Mehta dismissed the order after hearing brief submissions from the petitioner.During the hearing, the counsel representing the petitioner stated that a mosque was built in Murshidabad in the name of Babri Masjid despite Babar being cruel anti-Hindu invaders.This comes after former Jan Unnayan and Trinamool Congress chief Humayun Kabir on December 6, 2025 laid the foundation stone for the construction of Babri Mosque in Murshidabad and said that no one can move a single brick as the 37 per cent Muslim population of Bengal will build it at any cost.He pointed to the constitutional right to build places of worship, and said that he was not doing anything unconstitutional. “Just as anyone can build a temple or a church, so can I,” he said.Kabir stressed that legal challenges will not prevent the construction of the mosque. “Five cases have been filed against me, but no one can stop the one whom God is with. The court also clearly stated that it is written in the Constitution of India that one can build a mosque; this is a right,” he said.

On January 2, Kabir announced the construction of a hospital and a university besides Babri Mosque. “Babri Masjid will be built here, a hospital will be built, a university will be built, facilities will be created for the benefit of the people,” Kabir said at an event in Murshidabad.
