The Surat court partly allowed a private complaint filed by a VHP leader and his lawyer, finding sufficient reason to believe that the posts could foster hostility between the communities.
A Gujarat court has directed to register a case against Anurag Kashyap over his statements about the Brahmin community
According to a PTI report, the Judicial Magistrate Court First Class (JMFC) ordered AS Jani to register a criminal case against Indian filmmaker Anurag Kashyap under Bharatiya Nyaya Sanhita Section 196 (promoting enmity between different groups), 352 (intentional insult with intent to create breach of public peace), and 353 (2) (circulating false information). The court noted that there was reason to believe that the accused had published a post on social media in a way that defamed a particular community.
About the complaint against Anurag Kashyap
The complaint was filed by lawyer and Vishwa Hindu Parishad leader Kamlesh Raval, who hails from the Brahmin community. He had moved the court over Kashyap’s posts on X, which he claimed were in reaction to the protests against the trailer of the Hindi film “Phule” on April 16 last year. According to the complaint, when the All India Brahman Samaj objected to the release of the trailer, Kashyap posted remarks defaming the Brahmin community and continued to do so in response to those who objected.
“The entire Brahmin community has opposed the accused’s post. Such a post poses a risk of spreading enmity between different communities and classes. The accused works in the Hindi film industry and is also an actor. From young children to senior citizens, everyone watches movies and tries to imitate actors,” the complainant said. The complaint also referred to Kashyap’s earlier post dated January 8, 2020, in which he allegedly made objectionable remarks about Hindus and accused the Union government of being “casteist” and having a “criminal mentality”.
A Non-bailable matter A judgment has already been issued against Anurag Kashyap
Raval stated that several summons were sent to Kashyap, but he failed to respond to any of them. The court subsequently issued a non-bailable order against him. Anurag Kashyap is yet to issue a public statement in response to the court order.Disclaimer: The information in this report is based on a legal hearing as reported by an external source.
