Deputy Commissioner of Police (External) Vikram Singh said that a case under Sections 64 (1) (rape), 70 (1) (gang rape) and 3 (5) (common intention) of Bharatiya Nyaya Sanhita was registered against the two men on Tuesday.

The Attorney General said: “The two men have been arrested and sent to judicial custody. They will be charged soon. We will ensure a speedy trial.”

A senior police officer said that the accused are Umesh Kumar and Ramendra Kumar, both in their late 30s and hailing from Uttar Pradesh.

The woman was standing at a bus stop at Saraswati Vihar on Outer Ring Road and allegedly entered the bus around 12:15 am on Tuesday, after which she was allegedly pushed to the back of the bus where she was allegedly raped by the two men, according to police.

The bus arrived near Nangloi railway station around 1 a.m. and then stopped, according to police

The woman, a resident of Pitampura, said: “I was raped while the bus was moving, and it continued after it stopped.”

However, the police denied that the rape occurred on the moving bus, but claimed that she was sexually assaulted after the bus stopped.

The woman managed to get out of the bus around 2:45 a.m. and called the police a minute later, after which staff of Nangloi Police Station arrived at the scene, police said.

“I told the men to release me and that I would not take any action against them, and that is why they released me,” the woman said.

Police said Umesh was at the spot while Ramendra fled when Nangloi police station staff appeared.

According to the first information report, the details of which were conveyed to H.T. by senior police officers, there were two other people on the bus who had no role to play in the alleged crime.

Umesh was arrested on the spot while Ramendra was arrested a few hours later, the police said, adding that they were produced before a Delhi court and sent to judicial custody till Monday.

The woman was taken for a medical examination to Bhagwan Mahavir Hospital, where, according to police, doctors confirmed that she had been raped.

The FIR, according to senior police officers, was lodged in the presence of government advisors. The bus had black tinted windows and high curtains, which is banned in the capital according to a 2012 Supreme Court directive.

When the HT investigated the 8-km stretch that the bus traversed between the woman who allegedly entered it and the stop near the Nangloi Metro station, the HT discovered at least two police booths at Raj Park and Biragarhi Junction, where police officials were present.

A senior police officer said that thousands of vehicles passed through this road and nothing unusual was spotted.

Her husband said: “On Monday, we all went to her brother’s house in Sotanburi to help him change his house. While my daughters and I returned, she stayed put. She did not carry a phone. She called her brother around 10:30 pm and he said she had left. I waited for her all night but she did not come.”

The husband said he received a call around 1pm on Tuesday from his wife, who was calling from Rani Bagh police station, asking him to meet her there.

The husband added: “When I arrived (the police station), she told me that she had been raped, and that she would be taken to court to testify before the judge.”
