The Ministry of Human Resources and Emiratisation (MOHRE) has clarified when employees in the UAE can legally transfer to a new company after their employment contract expires, while also warning workers that certain violations could result in a one-year work permit ban.The latest clarification comes as thousands of employees across the UAE continue to change jobs in a highly competitive labor market, especially in sectors such as hospitality, retail, construction, logistics and technology. The Ministry confirmed that workers can move to another employer once the employment relationship officially ends, either after the contract expires or when both the employer and employee agree to end it.This announcement aims to remove confusion among workers who still believe that outdated work restrictions and No Objection Certificate (NOC) requirements still apply.

Rules for changing jobs in the UAE 2026

Under current UAE labor regulations, employees can legally transfer to another company once their employment contract expires, and both parties mutually agree to terminate the contract, complete the required notice period, and properly cancel their current work permit and residency visa.

This clarification is important because many workers still believe that they need a No Objection Certificate (NOC) from their previous employer before joining another company. However, the UAE has largely removed the outdated work ban system following the issuance of Federal Decree Law No. 33 of 2021, making job mobility easier for most employees.The Ministry of Human Resources and Emiratisation also confirmed that workers can remain within the UAE during the official grace period after the end of their work.

During this period, employees can search for a new employer, transfer their visa, adjust their residency status, or legally exit the country before the grace period expires. Depending on the visa category and type of residence, the grace period can range from 30 days to up to six months.

Emirates work violations

While the UAE has eased job transfer rules, authorities have confirmed that some labor violations can still result in a one-year work permit ban.According to the Ministry of Human Resources and Emiratisation, restrictions may apply in cases involving unauthorized absence from work, violations during probationary periods, failure to fulfill contractual obligations, or labor law violations proven against the employee.The Ministry particularly highlighted the rules related to resignations during the probationary period. Employees who plan to transfer to another company during the probationary period must provide written notice to their employer under the UAE Labor Law.

In some cases, the new employer may also be required to reimburse the previous employer for employment-related expenses unless the parties agree otherwise.Legal experts say many employees continue to rely on outdated information from legacy work systems that imposed automatic six-month or one-year bans. However, most of these restrictions have now been removed or significantly reduced under more recent labor reforms.

UAE visa transfer process

One of the biggest labor reforms introduced in recent years is the ability for employees to transfer to a new employer without leaving the UAE.The process generally begins with the cancellation of the previous work permit and residence visa, followed by a new work permit application submitted by the new employer. Employees then complete procedures to adjust their status within the country, in addition to medical fitness tests and Emirates ID procedures before a new residence visa is issued.Labor and immigration specialists say the process typically takes between two and four weeks once an employee has completed the notice period and documentation requirements.The reforms are part of the UAE’s broader efforts to build a more flexible and globally competitive labor market capable of attracting skilled professionals while supporting private sector growth.

Looking forward

The UAE has steadily modernized its labor system since the updated labor law framework came into effect in 2022.Recent reforms have made it easier for employees to switch companies through in-country visa transfers while reducing reliance on mandatory NOC approvals in most situations. The authorities have also introduced clearer rules around probationary periods, fixed-term contracts, notice periods and grace periods after employment.Officials have repeatedly advised workers and employers to rely only on official Ministry of Human Resources and Emiratisation announcements and verified legal directives rather than outdated information on social media or unofficial advice circulating online.Recruitment specialists say the updated framework has significantly improved labor movement across the UAE while maintaining safeguards for employers through structured notice periods and compliance rules.
