The US says the number of Indians applying for green cards through the EB-5 program is increasing.
Indian-origin tech entrepreneur Vijay Thirumalai has defended anti-Indian hate on social media that has found a new excuse through the EB-5 green card program after the State Department issued a May 2026 visa bulletin.
The green card for EB-5 investors from India may see a sudden backlog as there is a huge demand for this green card, the ministry said. “Sufficient demand and increased use of numbers by India in unreserved EB-5 visa categories may make it unnecessary to move back the final action date or make the category unavailable to accommodate the use of numbers within the maximum permitted under the FY 2026 annual limit. The situation will be continuously monitored, and any necessary adjustments will be made accordingly,” the visa bulletin said. For the EB-5 program, one has to create jobs in the United States to obtain a green card. USCIS’s warning that India is using this route more than before has sparked outrage among US CEOs. “This is the same country that already dominates the H-1B and OPT backlogs,” wrote Hani Girgis, founder of the US education technology company. “The entire employment-based green card system is collapsing under the weight of one country’s demand. It’s time to fix the caps and put Americans first.”
Thirumally protested against the targeting of Indian investors and reminded Girgis that these Indians pay taxes and invest $800,000 in the US for a chance at a green card. “Indians are doing a favor by investing in EB5 and not the other way around. Instead of spewing racist garbage and poison + a 7% cap on Indian investors, it would be much more beneficial for the US economy to have an expedited EB5 waiting list for Indians, so US companies can save billions of dollars in cost of capital every year,” Thirumalai wrote. “Without Indian demand, 95% of EB5 projects would not be fully subscribed, and valuable lenders and assets such as senior housing, data centers and industrial storage that help the US economy could not be built,” Thirumalai added.
