The Juvenile Justice Board (JJB) on Tuesday granted bail to the 17-year-old boy accused in an accident that killed 23-year-old motorcyclist Sahil Dhanishra in Dwarka, observing that justice would still be served if the accused is released.

In a 16-page order, Principal Magistrate Chitranshi Arora noted that lack of adequate parental supervision contributed to the incident and granted bail on personal bond of Rs. $20,000. “The incident arose against the backdrop of inadequate parental supervision… The parents of the CCL (Child in Conflict with the Law) admitted their fault, accepted responsibility for the child’s behaviour, and expressed their willingness to adopt corrective and preventive measures, including strict supervision,” the order noted.
The accident took place on February 3 this year when Dhaneshra was traveling on his two-wheeler, and was hit by a speeding SUV, allegedly being driven by the teenager, which then rammed into a parked taxi, seriously injuring its driver as well.
The minor, who does not have a driving license, was arrested and referred to the observation center. The police have registered a case under the provisions of the Bharatiya Nyaya Sanhita (BNS) Act which deals with rash and negligent driving, causing death due to negligence and endangering human life. The juvenile’s father was also restrained by police.
Six days after his arrest, on February 10, the JJB granted interim bail to the 17-year-old to enable him to appear for the Class 10 board examinations, and ordered him to surrender on March 9 after completion of the examinations.
In Tuesday’s order, the judge refused to consider the prosecution’s claim that the minor defendant was in the habit of committing crimes.
