In response to a civil suit filed by Rani Kapoor, who alleged that the RK Family Trust or Rani Kapoor Family Trust was used to illegally appropriate her property, Priya Kapoor argued that her mother-in-law had “perpetrated a fraud on the court” and sought dismissal of the case against the trust.

“Yesterday the court suggested mediation and requested Priya to take proactive steps… and today she is filing a false complaint against an 80-year-old,” Rani Kapoor’s lawyer told the bench.

What did the High Court say?The complaint came a day after the High Court raised concerns over family feuds.

Families are involved, but the way forward is that you all resolve the dispute in a peaceful manner; should not turn into a blessing.”

The bench issued notice seeking Rani Kapoor’s reply within four weeks, saying that a revival could be filed within the next two weeks.

Priya Kapoor’s petition argued that the civil suit amounted to a gross abuse of process, alleging that Rani Kapoor had misled the court by lying and concealing material facts.

Rani Kapoor, who claimed last year that she was coerced into signing documents while mourning her son’s death, asked the court to declare the conviction “the result of fraud, fraud and undue influence”. He also sought consequential relief including dissolution of the trust and recovery of assets.

More details of the caseAccording to the suit, Rani Kapoor is the sole beneficiary and heir of the estate of her late husband, Sona Group founder and promoter Surinder Kapoor, who died in June 2015. Sanjay Kapoor’s will was probated in January 2016 without objection.

The suit also alleged that after suffering a stroke in September 2017, Rani Kapoor became physically and emotionally dependent on her son and Priya Kapoor, who diverted her assets to the RK Family Trust without her consent.

Both parties, including Karisma Kapoor and her children, children from Sanjay Kapoor’s second marriage, have exchanged accusations of cheating as the legal battle intensifies.

In early December, Rani Kapoor accused Priya Kapoor of hiding her son’s wealth, claiming that she only ₹1.7 crore in cash and no investment despite a reported earnings ₹60 crore salary.

Sanjay Kapoor, 53, died on June 12 last year while playing polo in London. Although the death was initially reported as cardiac arrest, it was suggested that he suffered anaphylactic shock.
