Ochoa, a 43-year-old Border Patrol agent, and Gutierrez, a 35-year-old Customs and Border Protection (CBP) officer, have been identified as Pretty’s shooters, according to government records seen by ProPublica.

Some X users shared an April 2025 post by ICE, which included a photo of a man named Raymundo Gutierrez-Castaneda, who was removed by ICE because of his criminal record. ICE noted that he was from Mexico and had been removed, adding that he had been convicted of “Attempted Rape – Child Victim, Assault with/Deadly Weapon.”

One X user shared ICE’s post, writing, “The thugs who killed Alex Pretti are now busted! They are CBP Agents Jesus Ochoa and Raymundo Gutierrez – who has a criminal record and DHS hired him anyway! So here we have two deportable Hispanics killing a Caucasian on an American street – precisely to protect us from Trump.”

Another user wrote, “Raymundo Gutierrez-Castaneda who murdered Alex Pretty is a convicted rapist. That’s why he’s an ultra-moga. That’s why Donald Trump appointed him. The entire Republican Party is nothing but violent perverts.”

Here is the truthDespite the sensational claims, the truth is that ICE’s old post is being shared with a false narrative. CBP officer Raymundo Gutierrez and Mexican national Raymundo Gutierrez-Castaneda are two different people.

Ochoa and Gutierrez were assigned to Operation Metro Surge, an immigration enforcement operation that began in December that sent armed agents into Minneapolis. Gutierrez, who joined in 2014, works for CBP’s Office of Field Operations, and is assigned to a special response team, which conducts high-risk operations, such as police SWAT units. He is from South Texas, according to records, Ochoa.

Gutierrez-Castaneda, on the other hand, is a Mexican national. In April 2025, ABC 15 News reported that agents in Colorado removed him from the United States after he was convicted of attempted rape of a child and assault with a deadly weapon.

Although Pretti’s shooter and the Mexican national share the same name, they are different people. Photos of Gutierrez-Castaneda and old posts from ICE are being shared falsely claiming he was removed.

Authorities have not publicly released the names of the agents who killed Pretty, but the Department of Homeland Security (DHS) confirmed this week that they fired Glock pistols during the altercation. Both of them have been placed on administrative leave. The Justice Department’s Civil Rights Division announced it is investigating the shooting.
